Many people ask what is a diversion? The County Attorney's office sees most diversions through traffic-related offenses. A diversion is a contract between the State of Kansas (through the County Attorney's office) and the defendant. If you are facing criminal or traffic-related charges, a first-time offender can apply for a diversion. The diversion process occurs after someone is charged with a crime but before the finding of guilt. If someone accepts a diversion, that stops the case until they either complete diversion or fail to complete it. If you successfully complete diversion, the criminal charge is dismissed. If you fail to complete diversion, you face receiving a conviction.
Who is eligible for diversion? That depends on the criminal history, the extent of harm caused by the defendant in the criminal conduct, whether the victim finds it acceptable, whether the victim induced or facilitated the commission of the crime, and whether the victim has compensated or will compensate the victim. The generally accepted practice is people with no criminal history and only on crimes that have not harmed anyone.
While on diversion, people are expected to pay court costs, diversion fees, and if there's a victim, pay them restitution. People on diversion are expected to make regular appearances with our diversion officers. They are to gain and maintain work. If they are in school, they are expected to keep up with their schoolwork and receive passing grades. In specific cases, victims are also expected to participate in programs to help them rectify whatever issue caused them to be in trouble, such as alcohol or drug classes and mental health programs.
The purpose of diversion is to try to help people without hurting their criminal record. For more information, please see our website at www.leavenworthcountyattorney.org .

Battery and Small Electronic Recycling
When It Comes to Small Electronics and Batteries Recycling Only You Can Prevent Fires!
COULD YOUR TRASH OR RECYCLING BIN BE A FIRE HAZARD?
Excited about your new smartphone purchase, you pull it out of the case and set up your new device. Your old phone which has just been replaced by the new model remains lying on the counter, ready to be discarded.
It is an electronic, and certain electronics shouldn't go to the landfill. But wait! Did you know that if you throw your old phone in your recycling bin at home, you can create a serious fire hazard? Batteries, when faulty or crushed, can spark or explode.
In addition to fires breaking out at waste facilities, trash and recycling collection trucks have also gone up in flames from lithium-ion batteries. These fires are an extreme safety hazard for both drivers and the people working in the facilities and the surrounding communities.
HOW TO SAFELY DISPOSE OF USED BATTERIES AND SMALL ELECTRONICS, SUCH AS PHONES
Batteries and small electronics don't belong in recycling or trash. Instead, take them to a safe collection site and for Leavenworth County residents that can be The Leavenworth County Transfer Station . You will pull onto the scale and let the attendant know that you have batteries or electronics to recycle.
On your next trip to the hardware, home improvement, electronics, or household goods store, you could check to see if the store offers a battery and small electronics recycling program. These stores often locate special bins to recycle batteries or small electronics near entrances and exits and may be adjacent to special plastic bag recycling bins.
Help keep everyone safe, including your community and the environment, by safely disposing batteries and small electronics.
