In the New Year, the Leavenworth County Attorney's office and local attorneys want to offer those with a record a fresh start. The attorneys will provide free legal services to help those with a criminal arrest or conviction in Leavenworth County seek an expungement. We hope this will help remove barriers such as employment restrictions and housing opportunity issues for those with a record.
An expungement means that your past arrest record, or conviction, will be sealed.* When a person's record is expunged, no information related to the arrest or conviction may be disclosed, with certain exceptions. *Only adult convictions, arrests, and diversions in Leavenworth County may be eligible. Federal and municipal court cases cannot be addressed through this event.
This opportunity is scheduled yearly; this website will be updated when current dates are established. Forms for expungements are found here. Completed forms should be returned to the Leavenworth County Attorney's office. Those wanting an expungement will be responsible for researching their record and filling out these forms.
Once your completed form is submitted, the Leavenworth County Attorney's office will review your information to see if you meet the criteria for an expungement. Review this website to see if you may be eligible for expungement.
For individuals seeking to expunge a person's crime, the Leavenworth County Attorney's office will contact the victim before entering the expungement process for that conviction.
When the Leavenworth County Attorney's office completes this process, your chosen volunteer attorney will contact you. It is your responsibility to provide and maintain current contact information. The assigned attorney will inform you if you are eligible for an expungement. If you are not eligible, these attorneys will inform you why and what you may need to do for qualification. The volunteer attorneys are only available to help answer questions, explain the expungement process, or notify you if you are eligible for expungement. The Leavenworth County Attorney's office does have a right to challenge any expungement filings. If the expungement is not approved, and you wish to challenge this decision, you must retain an attorney.
Finally, there are fees required. The filing fee and surcharge are responsible for those seeking expungement. These fees may be waived, but you must complete a "Request to Waive Filing Fee with an Affidavit of Poverty or Affidavit of Indigency" form. If you feel you qualify, please get in touch with the attorney assigned.
